Terms of Service

1. Legal Operator

The Streetwise mobile application (the "App") is operated by:

Streetwise is currently operated as an independent project and not as a registered company.

By accessing or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.

2. Description of the Service

Streetwise is a pedestrian navigation and informational application that provides:

• Route suggestions
• Safety scores
• Aggregated incident data
• User-submitted reports
• AI-based conversational features
• Optional emergency contact tools

The App is a decision-support informational tool based on aggregated, probabilistic, and third-party data.

The App does not guarantee safety, prevention of harm, or risk elimination.

3. No Emergency Service

Streetwise is not an emergency service provider.

• We do not monitor users in real time.
• We do not dispatch law enforcement or medical services.
• We do not guarantee that emergency contacts will be reached.
• We do not guarantee that AI features will function at all times.

In case of danger, you must contact official emergency services directly (112 in the European Union).

You acknowledge that the App is not a substitute for emergency services.

4. Assumption of Risk

You acknowledge that:

• Traveling in public spaces involves inherent, unpredictable, and potentially dangerous risks.
• Crime, harassment, and unsafe conditions may occur regardless of route selection.
• Data used by the App may be incomplete, inaccurate, outdated, or probabilistic.

You assume full responsibility for your personal safety and for all decisions made while using the App.

5. No Warranties

To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE".

The Operator makes no warranties, express or implied, including but not limited to:

• Safety of any route
• Accuracy of safety scores
• Accuracy or completeness of incident reports
• Reliability of AI outputs
• Continuous or error-free availability
• Fitness for a particular purpose
• Non-infringement

We do not warrant that the App will prevent harm, crime, harassment, or injury.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

The Operator shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of opportunity
• Emotional distress
• Loss of data
• Personal injury resulting from user decisions
• Acts of third parties
• Criminal acts committed by others
• Failures of third-party services

Total aggregate liability arising out of or related to the App shall not exceed:

€100 (one hundred euros).

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct where legally applicable.

7. Third-Party Services

The App relies on third-party services, including but not limited to:

• Mapping providers
• Hosting infrastructure
• Authentication providers
• SMS or communication services
• Public crime data sources

We do not control and are not responsible for third-party services, their availability, or their data accuracy.

8. User Accounts

You may create an account using email, Google, or Apple Sign-In.

You are responsible for:

• Maintaining account confidentiality
• All activities under your account

You may delete your account at any time within the App. Data handling is governed by our Privacy Policy.

9. User-Generated Content

You may submit incident reports.

By submitting content, you grant the Operator a non-exclusive, worldwide, royalty-free license to use, process, display, and distribute such content within the App.

You agree that:

• Reports must be truthful and not misleading.
• You will not submit defamatory, abusive, or unlawful content.

We reserve the right to remove or moderate content at our discretion.

You remain solely responsible for content you submit.

10. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your misuse of the App
• Your violation of these Terms
• Your submitted content
• Your unlawful or negligent conduct

11. Prohibited Conduct

You agree not to:

• Submit false or manipulated reports
• Attempt to distort safety scores
• Harass, stalk, or endanger others
• Reverse engineer or extract source code
• Interfere with infrastructure
• Use the App for unlawful purposes

12. Intellectual Property

All intellectual property rights in the App (excluding user-generated content) belong to the Operator.

You may not reproduce, modify, distribute, or commercially exploit the App without prior written consent.

13. Force Majeure

The Operator shall not be liable for failure or delay resulting from causes beyond reasonable control, including but not limited to:

• Network outages
• Government actions
• Data provider failures
• Natural disasters
• Cyberattacks

14. Termination

We may suspend or terminate access if you violate these Terms.

You may stop using the App at any time.

15. Changes to the Terms

We may update these Terms from time to time.

Material changes will be notified through the App or by email. Continued use constitutes acceptance.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of France. Any disputes shall be subject to the jurisdiction of the courts of Paris, France, without prejudice to mandatory consumer protections under applicable EU law.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and the Operator regarding use of the App.
